Asbestos Litigation

M&B partners and associates bring over one hundred years of collective experience in the New York asbestos litigation to the defense of our clients.  Since the founding of the firm in 1999, our attorneys have focused on the defense of corporate clients named as defendants in over 40,000 asbestos personal-injury actions in New York State.  As the litigation continues to evolve in both New York City and throughout the state, M&B enjoys the reputation of being one of the premier defense firms involved in the constantly changing New York asbestos litigation.

For the majority of our clients, we provide full coverage throughout New York state, including in the New York County Asbestos Litigation docket ("NYCAL") and in the upstate New York litigation which includes the cities and counties of Buffalo, Binghamton, St. Lawrence (Massena), Rochester, Rome, Schenectady and the Albany/Capital District region.  Although several M&B attorneys have extensive experience in toxic tort and non-asbestos product liability matters and continue to do this work and other complex litigation, our primary client base, and the focus of our firm, involves the representation of defendants in the asbestos litigation.

The New York asbestos docket is a challenging and aggressive venue with frequent impact on the asbestos litigation on a national level, necessitating a dynamic and skillful approach to the defense of these cases.  We bring a high level of expertise, experience and innovation to the defense strategy that we carefully hone for our each of our clients.

Although many of our attorneys have extensive experience in toxic tort and non-asbestos product liability matters, as well as a variety of other areas of complex litigation, M&B has focused for years on the defense of corporate clients named as defendants in over 30,000 individual personal-injury actions in New York State.  M&B partners and associates bring over one hundred years of collective experience in the New York asbestos litigation to the defense of our clients.  As the litigation continues to evolve in both New York City and throughout the state, M&B enjoys the reputation of being one of the premier defense firms involved in the New York asbestos litigation.  While the majority of these claims are filed in New York County, a docket that continues to represent one of the largest and most active asbestos litigation dockets anywhere in the United States, we have witnessed the number of upstate New York claims increase dramatically over the last few years.  As a result, for the majority of our clients, we provide full case coverage throughout New York State, including the Buffalo, St. Lawrence County (Massena), Rochester, Binghamton, Rome, and Albany / Capital District regions.

M&B is a member of the Asbestos Medical Defense Group in both the NYCAL and the upstate New York litigations, making M&B one of the few firms in New York state to be a member of both groups.  In addition, M&B has taken the lead on several complex special projects pertaining to global defense issues, including spearheading the research, briefing and oral argument which resulted in overturning an application of CPLR Article 16 which was particularly detrimental to NYCAL defendants seeking to try an effective allocation case in New York State Court; this decision was affirmed unanimously by the Appellate Division.  M&B also played a key role in the development and implementation of the New York County inactive docket.

As a result of our collective performance and tenure in the New York asbestos litigation, a docket subject to the national spotlight, M&B attorneys possess the knowledge to protect our clients from the historic pitfalls of the asbestos litigation, the skills and experience to effectively try both a products and a medical case implementing innovative and tailored defenses, and the demonstrated ability to effectively settle cases.  In light of the increasingly contentious climate pervading the New York and national asbestos litigations, where even a single adverse verdict can have serious consequences on any corporate defendant, M&B attorneys are called upon with increasing frequency.
