Maryellen ConnorPartner

Ms. Connor has specialized in the defense of asbestos, toxic tort, product liability, and medical/scientific litigation, including pharmaceuticals and medical devices, for over 15 years. She has served as lead medical counsel in toxic tort and product liability cases in numerous jurisdictions nationwide and has prevailed on causation defenses utilized in dispositive motions or as part of pretrial/trial strategy in various state courts, including California, West Virginia and New York. She has represented some of the nation's leading petrochemical companies, chemical manufacturers, and medical device and pharmaceutical manufacturers, including Hoechst Celanese, Pennzoil, Baxter Healthcare and Zeneca (now AstraZeneca) in litigations involving benzene, petrochemicals, solvents, latex gloves and the breast cancer drug Tamoxifen (Nolvadex).

Given her involvement in these types of cases, Ms. Connor has worked closely with the nation's leading scientific and medical expert witnesses on cutting-edge causation issues, including extensive work with numerous cancer specialists, epidemiologists, immunologists and industrial hygienists at the nation's leading medical facilities and academic institutions. She has established longstanding relationships with these experts and is highly respected for her understanding of complex medical and scientific issues and the nexus between science, medicine and the law.

Most recently, Ms. Connor developed the medical causation defense for a prominent New York general contractor in a case alleging exposure to the solvent methyl ethyl ketone. This work included both trial court motion practice and significant appellate practice. After a protracted battle on both medical and scientific issues and general contractor/labor law issues, Ms. Connor obtained a favorable summary judgment ruling on the issue of direction and control under New York law, resulting in a dismissal of all claims against the general contractor. Ms. Connor also currently represents a solvent manufacturer in personal-injury actions alleging exposure to benzene, which are pending in New York State Supreme Court in both Nassau and Suffolk counties.

For the past ten years, Ms. Connor has concentrated her practice on the representation of numerous defendants sued in the asbestos litigation in New York County and has played a lead role in both the development and management of these accounts and in creating defense strategies for these entities. While Ms. Connor has participated in the trial of numerous asbestos cases brought in New York County, she has also been lead counsel in defending dozens of cases pending against Westinghouse in state courts in New Jersey. She has successfully argued dispositive motions establishing or solidifying product defenses critical to Westinghouse in the New Jersey Counties of Camden and Middlesex.

Prior to joining M&B, Ms. Connor was senior counsel in the Washington, D.C. office of Akin, Gump, Strauss, Hauer & Feld. Ms. Connor graduated cum laude from Lehigh University and received her law degree from the Georgetown University Law Center. While at Georgetown, she was a member of The Tax Lawyer Law Review. She is a member of the New York, District of Columbia and Pennsylvania Bars.
